ACB Jammu produces charge-sheet against ex-Patwari

In case FIR No. 01/2020 P/S ACB-Jammu U/S 7 (a) PC Act (amendment 2018) r/w PC Act 1988 against Romesh Chander then Patwari Halqa, Bhaddu Tehsil Billawar, the charge sheet was presented before Addl. Sessions Judge Anti-Corruption Kathua.

Sh. Hukam Chand, S/o Sh. Mallu Ram R/o Beral, A/P Bhaddu Tehsil Billawar District Kathua, filed a written complaint alleging that his father purchased 04 marlas of land from Sh. Subash Chander S/o Chandu R/o Barel, in khasra No. 2244/1694, in the year 1998, and that his father died about 10 years ago. The complainant went on to say that he and Subash Chander sought Romesh Chander Patwari Halqa Bhaddu for a ‘Fard Intikhab,’ and that he was told to file an application and have it marked to him from Tehsildar Billawar. As a result, he filed an application with the Patwari, and the Patwari approved it. Romesh Kumar invited him to his office on January 16, 2020.

On 16.01.2020 he went to the Patwari concerned who demanded Rs. 10,000/- as bribe for issuance of ‘Fard Intikhab’. Because the complainant refused to accept the bribe, he filed a formal complaint against the Patwari and urged that legal action be taken against him. Following receipt of the instant complaint, a pre-trap investigation was carried out, which revealed that the Patwari in question had really asked and accepted to receive a bribe of Rs. 10,000/- in exchange for the issuing of a ‘Fard Intikhab.’ On the basis of this complaint and pre-verification report, case FIR No. 01/2020 U/S 7 of PC Act 1988 (as amended in 2018) was registered at P/S ACB-Jammu.

Following the filing of the FIR in this case, a trap team was formed to lay the trap. Following that, a trap was set, and the accused Romesh Chander, then Patwari Halqa, Bhaddu, was caught red-handed soliciting and taking a bribe of Rs. 10,000/- from the complainant in front of independent witnesses.

After completing the investigation and obtaining prosecution sanction against the accused public servant, a charge sheet for commission of an offence under Section 7 of the PC Act 1988 (as amended in 2018) was presented to the Hon’ble Addl. Sessions Judge, Anti-Corruption, Kathua for judicial determination today on 05.10.2021.

The next hearing date in this case FIR has been set for November 17, 2021.
