Himachal Pradesh: Former Congress Leader Arrested for Communal Social Media Posts

A former leader of the Congress party has been apprehended in Himachal Pradesh for allegedly disseminating content on social media that targets a specific community and employs offensive language. The arrested individual, identified as Yudhvir Singh Bains, aged 54, is a resident of Mandi district.

Information was available with The Chenab Times that the arrest followed a complaint lodged with the police. The complainant asserted that Yudhvir Singh Bains had published a video on his social media accounts containing material that could potentially incite division among various religious communities.

The complaint further detailed that the video had garnered a substantial viewership and possessed the capability to disrupt law and order and undermine communal harmony within the region. Confirming the development, Senior Superintendent of Police (SSP) of Shimla, Gaurav Singh, stated that preliminary investigations revealed the accused regularly posts videos on his social media platform. The content of these videos was deemed offensive and capable of negatively impacting communal harmony and fostering inter-community tension.

SSP Singh elaborated that a case was registered under sections 196, 299, and 353(2) of the Bharatiya Nyaya Sanhita (BNS), 2023, based on the complaint, and an investigation commenced. He added that the accused was formally requested to cooperate with the investigation but reportedly refused. Instead, he began recording police personnel, an act which was interpreted as obstruction of the investigation process.

Due to this conduct, section 221 of the BNS, 2023, was subsequently added to the charges. The SSP confirmed that based on the gathered facts and the ongoing investigation, the accused was taken into custody. He also noted that the individual has several other cases registered against him.

The Bharatiya Nyaya Sanhita (BNS), which came into effect on July 1, 2024, aims to replace the Indian Penal Code (IPC) of 1860. Section 196 pertains to punishment for offences relating to statements making or publishing pronouncements to commit an offence. Section 299 deals with punishment for criminal intimidation, while Section 353 relates to assault or criminal force to deter a public servant from discharging their duty.

The incident highlights the increasing scrutiny of social media content and its potential impact on public order and inter-community relations. Authorities have been increasingly active in addressing online content that is perceived as inflammatory or likely to cause social unrest, particularly in regions where maintaining communal harmony is a priority.

The arrest underscores the legal framework in place to address such grievances and the proactive measures being taken by law enforcement agencies to maintain peace and order. The investigation into the matter is continuing, with further details expected to emerge as the legal process unfolds.
