The Income Tax Department has initiated a widespread investigation into suspicious foreign remittances, targeting entities that have transferred substantial amounts of money abroad without commensurate reported business activities or income. This nationwide exercise is based on data analysis and intelligence gathered regarding outward foreign remittances over the past three years.
Nationwide Verification Exercise Uncovers Irregularities
Information was available with The Chenab Times that the Income Tax Department has identified numerous entities that remitted significant foreign exchange during the last three years. These findings emerged from a broader search operation that uncovered a network of fictitious charitable trusts allegedly involved in facilitating accommodation entries through bogus donations. Preliminary verification revealed that many of these remitting entities were either non-filers of tax returns or reported very modest turnovers that bore no relation to the large sums sent overseas.
Further scrutiny indicated that the stated purposes for these remittances, such as payments for freight, software imports, or consulting services, did not align with the financial profiles of the entities. Ground-level intelligence also suggested that many of these entities were not operating from their registered addresses, raising concerns about their legitimacy.
Concerns Over Professional Certifications
The investigation has also cast a spotlight on the role of professionals who issue Form 15CB certificates, a mandatory requirement for overseas remittances. Data analysis revealed that a relatively small group of professionals had issued a large volume of these certificates. Form 15CB, governed by Rule 37BB of the Income-tax Rules, 1962, requires accountants to verify the taxability of remittances based on the remitter’s financial records. The department’s findings suggest potential shortcomings in the due diligence exercised by some accountants before issuing these certifications.
The department launched a detailed verification exercise on August 18, 2026, to scrutinize these foreign remittances. The focus is on identifying shell entities, the individuals orchestrating them, and the professionals who provided the Form 15CB certifications. The exercise includes entities located in districts along India’s land borders that have remitted substantial amounts abroad. In total, approximately 394 entities, including 117 in land-border states, and 36 professionals have been brought under the ambit of this verification.
Accountants Urged to Exercise Due Diligence
The Income Tax Department has reiterated the importance of due care, diligence, and professional judgment for accountants issuing certificates in Form 15CB or its equivalent. These certifications play a crucial role in maintaining the integrity of the financial system, and accountants are expected to thoroughly examine underlying transactions and relevant facts before certifying remittances. Further investigations into the identified cases are currently ongoing.
