A case has been registered against a man for allegedly raping a 17-year-old girl and subsequently threatening to make her video viral on the internet in the Rohru subdivision of Shimla district, Himachal Pradesh.
Information was available with The Chenab Times that the incident came to light after the victim fell ill on October 23 and was taken to a local hospital. During her examination, the teenager reportedly disclosed to her mother that she had been subjected to sexual assault. Following this disclosure, the mother approached the local police to file a formal complaint.
According to the complaint lodged with the authorities, the minor alleged that the accused, identified as Pawan, committed the act of rape at his rented accommodation in Rohru on October 15. The victim further stated that the accused had threatened her, warning that he would disseminate her video online if she revealed the incident to anyone. This alleged threat aimed to intimidate the minor and prevent her from seeking justice.
In response to the complaint, the police have registered a First Information Report (FIR). The case has been booked under Section 4 of the Protection of Children from Sexual Offences (POCSO) Act, 2012, which deals with the punishment for penetration of a child. Additionally, Section 64(1) of the Bharatiya Nyaya Sanhita (BNS), 2023, a new criminal code set to replace parts of the Indian Penal Code, has also been invoked. The BNS provisions will come into effect from July 1, 2024. Police officials have stated that an investigation into the allegations is currently underway to gather evidence and ascertain the veracity of the claims made by the victim and her mother.
The Rohru subdivision, located in the Shimla district of Himachal Pradesh, is a scenic area often associated with apple cultivation and tourism. However, like many regions across the country, it is not immune to incidents of crime. The case highlights the persistent challenges faced in protecting vulnerable individuals and ensuring swift justice under existing legal frameworks.
The POCSO Act, enacted in 2012, provides a robust legal framework for the protection of children from sexual abuse and exploitation. It mandates stringent penalties for offenders and emphasizes the need for swift trial and rehabilitation of child victims. The recent inclusion of provisions under the Bharatiya Nyaya Sanhita indicates the ongoing efforts to update and strengthen the country’s criminal justice system.
Authorities have stated that all necessary steps are being taken to ensure a thorough investigation into the matter. The police are gathering statements from the victim and witnesses, examining the rented accommodation where the alleged incident took place, and collecting any other relevant evidence that could support the prosecution’s case. The emphasis remains on ensuring that justice is served while adhering to legal procedures and protecting the rights of the victim.
