A Special National Investigation Agency (NIA) Court in Jammu has rejected the interim bail application of former Jammu and Kashmir Police Deputy Superintendent of Police (DySP) Davinder Singh, who had sought temporary release to attend post-demise religious ceremonies for his father. The court, however, granted him five days of custody parole on humanitarian grounds.
Information was available with The Chenab Times that Singh’s plea for interim bail was denied following opposition from the NIA, which cited the severity of the charges against him, including those related to national security under the Indian Penal Code, the Unlawful Activities (Prevention) Act, the Arms Act, and the Explosive Substances Act. The agency also noted that Singh’s regular bail appeal is pending before the High Court.
Davinder Singh had requested 20 days of interim bail after his father, Deedar Singh, passed away on July 17, stating the necessity to perform last rites and attend religious rituals. The NIA acknowledged the humanitarian aspect but expressed concerns that granting interim bail could potentially influence witnesses in the ongoing case.
Consequently, the court partially accepted the application, allowing custody parole purely on humanitarian grounds. This parole permits Singh to participate in religious ceremonies, including the Akhand Paath, scheduled to take place from July 27 to July 30 at his residence in Mehjoor Nagar, Srinagar.
The court has issued specific directives for Singh’s transportation and custody. He is to be taken to Srinagar by road or train under a police escort and must return to Kot Bhalwal Jail in Jammu by the evening of July 31. Throughout the five-day parole period, he will remain in custody.
Further instructions mandate that Singh be housed at the nearest police station while in Srinagar. He will be permitted to visit his residence daily between 10 am and 4 pm, under adequate security arrangements, with sufficient police personnel deployed for his escort and protection.
Davinder Singh’s arrest on January 11, 2020, followed an interception of a vehicle near Qazigund on the Srinagar-Jammu National Highway. At the time of his apprehension, he was with Hizbul Mujahideen militant Naveed Babu, Altaf Ahmad Rather, and advocate Irfan Shafi Mir. The case was subsequently transferred to the NIA, which has formally charged Singh with conspiring to facilitate militants and is currently prosecuting him before the Special NIA Court in Jammu.
