Delhi Appoints Deputy Commissioners as District Magistrates Under New Criminal Laws

The Delhi Government has officially notified the appointment of Deputy Commissioners as District Magistrates, a move that aligns with the implementation of new criminal laws in the National Capital Territory (NCT).

The Chenab Times has learned that the notification, issued by the Home Department on July 30, designates Deputy Commissioners of all districts within Delhi to serve as District Magistrates. This action is taken in accordance with the powers vested under Section 14(1) and 14(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023, and is further supported by a Ministry of Home Affairs notification dated June 28, 2024.

According to the directives, these appointed Deputy Commissioners will assume the responsibilities of District Magistrates for their respective districts. They are expected to hold these positions from the date they officially take charge until further directives are issued or until they relinquish their substantive posts as Deputy Commissioners, whichever comes first.

The notification also stipulates that Additional Collectors in Delhi’s districts will now function as Additional District Magistrates for their respective areas. These Additional District Magistrates will be empowered to exercise all the functions and powers conferred upon a District Magistrate, not only under the Bharatiya Nagarik Suraksha Sanhita but also under any other prevailing law.

Furthermore, the Delhi Government has appointed Revenue Assistants, Tehsildars, and Consolidation Officers from various tehsils, revenue areas, and the headquarters of the Revenue Department. These officials will serve as Executive Magistrates, holding jurisdiction over their assigned districts, tehsils, revenue areas, or headquarters.

The Home Department has clarified that this new notification supersedes all previous orders concerning similar appointments made under the erstwhile Code of Criminal Procedure. However, any actions already completed or those that were omitted to be taken prior to the issuance of this superseding notification will remain unaffected.

The Bharatiya Nagarik Suraksha Sanhita, 2023, is one of the three new criminal laws that have been enacted to replace colonial-era legislation. These new laws aim to modernize the country’s criminal justice system. The Bharatiya Nyaya Sanhita, 2023, replaces the Indian Penal Code, 1860, while the Bharatiya Sakshya Adhiniyam, 2023, replaces the Indian Evidence Act, 1872. The Bharatiya Nagarik Suraksha Sanhita, 2023, is the successor to the Code of Criminal Procedure, 1973.

The transition to these new laws necessitates administrative realignments to ensure their effective implementation at the ground level. The appointment of District Magistrates and Executive Magistrates is a crucial step in this process, as these officials play a vital role in the administration of criminal justice, including magisterial inquiries, maintenance of law and order, and other related duties as prescribed under the law. The previous appointment orders under the Code of Criminal Procedure, 1973, were in effect until the new legal framework came into force, requiring these updated designations.

The Home Department’s notification is a procedural update to align administrative roles with the new legal framework, ensuring that the functioning of the justice system continues without disruption. The designation of existing administrative officers to these roles under the new acts streamlines the transition and leverages their established experience in district administration.

The process of appointing officials under the new criminal laws is ongoing across various states and Union Territories, with each jurisdiction undertaking necessary administrative measures. Delhi’s notification reflects a proactive approach to adopting the new legislative mandates, ensuring that the designated authorities are in place to exercise their powers and responsibilities effectively from the outset of the new legal regime.
