Supreme Court rejects both appeals of highly educated youth, disqualifies for highly educated fourth class

J&K and Ladakh High Court rejects both appeals of highly educated applicants The courts rejected both the appeals of the highly educated applicants and upheld the decision disqualifying the highly educated youth for the posts of Class IV in government departments.




The court held that the employer has the right to determine the appropriate educational qualification for any position, provided it is not arbitrary or contrary to any standard of reasoning.

Upholding the decision of the single bench of the High Court, a division bench of Justice Ali Muhammad Magra and Justice Sanjay Dhar said that the educational qualifications of at least 10th class and at most 12th class for recruitment to Class IV posts are very clear. The court does not consider it arbitrary or wrong.




The bench said that the court could not interfere in determining which position the employer finds suitable for the applicant.

It can be intervened only when it is arbitrary and in this case it is not arbitrary.

The court said that there were a number of reasons behind fixing the maximum educational qualification for the 12th pass for Class IV posts.

If highly educated people get this position then they may not be a suitable option for small jobs, whereas 10th to 12th pass candidates will be able to do this job more effectively.

The bench said that even if the highly educated candidates get the posts of Class IV, they will continue their efforts for higher posts.

If they are selected for higher posts, the fourth tier posts will become vacant again, for which the recruitment process may have to be restarted.




The court said that if there is competition in recruitment from 10th to 12th class with highly educated persons, then only the highly educated will be selected.




In this case, the claim of the most suitable candidate for the advertised post will be affected.
