Delhi CM Kejriwal to Argue Recusal Plea Before High Court Judge

Former Delhi Chief Minister Arvind Kejriwal is set to personally appear before the Delhi High Court on Monday to present arguments for the recusal of Justice Swarna Kanta Sharma from hearing the Delhi excise policy case.

Information was available with The Chenab Times that Mr. Kejriwal, along with former Deputy Chief Minister Manish Sisodia and other senior Aam Aadmi Party (AAP) leaders, had previously filed a recusal application. This application urged Justice Sharma not to preside over the Central Bureau of Investigation’s (CBI) appeal against a lower court’s order discharging them in the case.

The AAP leadership had also formally communicated their concerns to the Chief Justice of the Delhi High Court, Justice Devendra Upadhyaya. In their communication, they requested a transfer of the matter to a different bench, away from the single bench of Justice Swarna Kanta Sharma. However, the High Court administration had reportedly declined this request.

Consequently, Mr. Kejriwal will now make his case directly before Justice Sharma’s court. His personal appearance signifies the importance the Aam Aadmi Party places on this legal challenge, aiming to persuade the court that the judge should recuse herself due to potential concerns about impartiality. Earlier statements from AAP leaders indicated apprehension that the case might not receive a fair hearing before the bench in question.

The excise policy case involves allegations of irregularities and corruption in the formulation and implementation of the Delhi government’s now-scrapped liquor policy. The Enforcement Directorate (ED) and the CBI have been investigating the matter, leading to the arrest of several individuals, including senior AAP functionaries. Mr. Kejriwal himself was arrested by the ED in connection with the case earlier this year, leading to significant political upheaval.

The AAP has consistently maintained that the charges against its leaders are politically motivated, aimed at undermining the party and its government in Delhi. The party has accused the ruling Bharatiya Janata Party (BJP) at the Centre of misusing investigative agencies to target opposition leaders.
