Chennai Court Dismisses Actor-Director SJ Suryah’s Plea to Discharge from Income Tax Evasion Cases

Chennai: A significant legal development has unfolded in Chennai as the Additional Chief Metropolitan Magistrate, Economic Offences Court-I, Egmore, has dismissed a discharge petition filed by actor-director S.J. Suryah. The petition sought to relieve him from criminal proceedings initiated by the Income Tax Department concerning alleged tax evasion over six assessment years spanning from 2002-03 to 2007-08.

The prosecution was launched under various sections of the Income-tax Act, 1961, including Sections 276C(1), 276C(2), 276CC, and 277. These charges relate to allegations of wilful attempts to evade tax, wilful attempts to evade payment of tax, wilful failure to furnish income tax returns within the prescribed time, and making false statements or false verification under the Act.

In her ruling, Additional Chief Metropolitan Magistrate P. Vidya stated that the complaints, oral evidence, and documentary evidence presented before the court established a prima facie case against the accused. Consequently, the court has directed S.J. Suryah to appear before the trial court for the framing of charges, after which the criminal trial will proceed as per legal procedures.

The Income Tax Department was represented by Special Public Prosecutor H. Siddharth. This judicial decision marks a continuation of the legal challenges faced by the actor in this matter. Earlier, the Madras High Court had dismissed S.J. Suryah’s petitions seeking to quash the criminal complaints. Subsequently, the Supreme Court of India also declined to grant him relief against the High Court’s order, thereby allowing the prosecution to move forward.

The High Court had observed that the Income Tax Act empowers a court to presume a culpable mental state of the accused unless proven otherwise, indicating that the actor would need to face trial. The Supreme Court’s decision to not grant relief further solidified the continuation of the prosecution.
