DLSA holds an awareness camp on the “POCSO Act 2012” in Bhaderwah

The District Legal Services Authority, Bhaderwah, today organised an awareness programme on the “Protection of Children against Sexual Abuse Act, 2012(POCSO); J&K Victim Compensation Scheme 2019 and The Juvenile Justice (Care and Protection of Children) Act 2015 here at Govt. Higher Secondary School (Girls) Bhaderwah on the instruction of Secretary DLSA Bhaderwah.

Advocate Mohd Majid Malik was the resource person, whereas Incharge Principal of the school, Brij Kumar , Sujata Devi, Teacher, Rajni Devi, Teacher, Sanjay Kumar , Sumira Tabassum, Jr. Assistant, PLVs, Afsha Shamim , Pryanka Sharma , Asha Dutt , Renu Parihar , Afzal Dev , Omesh Kumar , Sanjeet Charak  and others were also present on the occasion . The resource person, Adv Mohd Majid Malik  shared their knowledge on the subjects and tried to sensitise the participants about the core issues surrounding them.

He informed us that the POCSO Act 2012 is legislation which aims at protecting children from all types of sexual abuse and also informed us that this act provides strigent deterrents for the commission of offences against children ranging from a minimum of 20 years of imprisonment to the death penalty in the case of aggravated penetrative sexual assault.

Adv Mohd Majid Malik said the POCSO Act , 2012 is divided into 46 sections and threw light on the salient features of the POCSO Act and said Sections 24, 26  and 33 of the act lay down the procedure of the investigation and trail, keeping in view the needs of the child. He said the act provides for the establishment of special courts for the trial of offences and that the act incorporates child-friendly proceedings for reporting, recording of evidence, investigation and trail of offences. He was also informed that, according to Section 29 of the act, the person who is prosecuted for the commission of child sexual abuse offences is presumed to have committed or abetted or attempted to commit such an offence.

The burden of proof under the POCSO Act is shifted to the accused and the act was enacted when the cases of sexual abuse against children were rising . In the middle of the programme, a documentary film by Childline on “Good Touch and Bad Touch” was also screened for the students on the projector. More than 500 girls from the school participated in the camp and refreshments were also distributed among them by DLSA Bhaderwah.
