J-K High Court Protects Muslim Couple Threatened Over Marriage

Srinagar: The Jammu & Kashmir and Ladakh High Court has granted protection to a Muslim couple who approached the court seeking safety from threats posed by their relatives and others after their marriage. The couple claimed to have solemnized their union in accordance with Shariat law and out of their free will.

Hearing the petition titled Shakila and another V/s Union Territory of J&K and Ors, Justice Moksha Khajuria Kazmi observed that no individual, including the police, has the authority to interfere in the couple’s married life. The court noted that both individuals were adults and had entered the marriage voluntarily.

“This petition is disposed of by providing that none of the respondents including the police shall interfere or cause any interference in the married life of the petitioners. This direction has been given by this Court after having been satisfied that both the petitioners are major and have solemnized their marriage out of their free will and volition,” the court stated.

The counsel for the couple substantiated the claim that the woman was a legal adult by presenting a dental surgeon’s prescription certifying her as 45 years old, as corroborated by her Aadhaar card.

The couple had expressed fear of threats from their relatives and sought court-ordered protection. Based on the evidence and their statements, the court directed authorities to ensure that the couple’s married life remains undisturbed.

“Both the petitioners are before this Court and have made a statement that they have solemnized their marriage out of their own will and volition and that they are still together as husband and wife. If that be the position, nobody including the police has a right to interfere in their peaceful married life,” the court ruled.

This judgment, as reported by Bar and Bench, reaffirms the constitutional rights of adults to marry without interference from others, emphasizing personal freedom and legal protection.
