Following the unmasking of another scandal that has surfaced in Panchayat Nawapachi-B of Marwah block in Kishtwar District, 5 Panches of halqa Panchayat had moved a “No Confidence Motion” against BJP Sarpanch over allegations of corruption, favouritism, misuse of official position in the form of withdrawal of fictitious bills on the name of his family members and close relatives.
As per the details available with The Chenab Times, five Panches viz Shabir Ahmed Lone, Samena Begum, Panch & Naib Sarpanch, Mohammad Iqbal, Tariq Hussain Zarger, Ghulam Hassan and Mohammad Rafi Rafi Lone, submitted the No Confidence Motion Secretary Panchayat, Pyt. Halqa Nowpachi-B
Block Marwah ( Kishtwar) under Section 81 (1) of The Panchayati Raj Act, 1989 & P.R. Rules 1996 for removal of Sarpanch of Pyt. Nowpachi-B of RDD Block Marwah namely, Bilal Ahmed Khanday alias Ashiq Khanday by way of filing the present notice for No Confidence Motion added that it is a matter of grave concern that the alleged Sarpanch has been found misusing all his powers vested to him under PR Act by way of brazenly flawing all statutory norms contained under the relevant Act.
They submitted that Sarpanch of Pyt. Nowpachi -B going against the guidelines and provisions of PR Act as he has never ever taken consent of Panches, Naib Sarpanch of the Panchayat into confidence while constituting any Developmental work plans of the Panchayat.
“It has been observed that he along with his associate syndicate group do all such
actions under individual capacity and all exercises are done indoor without the information intimation to the other PRI representatives of the Panchayat, which gives clear apprehensions that the said Sarpanch in order to provide undue advantage to blue eyed / influential persons of the locality, he keeps on doing this unwarranted practice without an fear of rules & laws” read the No confidence motion letter handed over by the five Panches to Secretary Panchayat, the copy which is available with Chenab Times.
They said that the said Sarpanch in utter violation of laws, has made drawl of funds to the extent of lakhs of rupees by virtue of manipulating the documents in which he has been able to draw Material Cost and its carriage charges under MGNREGA and other schemes of Pyt. Nowpachi-B for the Funancial year 2019-20 and subsequent Fiscal Year of 2021-22 to the tune of Rs. 1365000/= and Rs. 2.50 Lakh respectively on the name of some forged material vendors, who are either his family members/ relatives or his sycophants. In this way, the alleged
Sarpanch has caused extensive loss to the Tax Payers money. This matter is gruesome in nature and invites a discreet investigation” they alleged.
They stated that the alleged Sarpach has brought such beneficiaries under the provisions of PMAY PM AWAS Plus Yogana, who are either in close relations with him and thus he has ignored the deserving
beneficiaries in a willful intention to provide undue benefits of the scheme to undeserving beneficiaries; The matter also requires a detailed verification.
They submitted that the alleged Sarpanch going against the laws and rules, as he has been found indulged in corruption practices by way of demanding Commission / Gratification amount from the beneficiaries viz, Skilled Workers/ Material Vendors for release of Wage/ Bill Payments etc against the workdone under various schemes applicable in Pyt. Nowpachi-B, which practice of the Sarpanch is unwarranted and unlawful beside has also made irregularities in distribution of Job cards.
They submitted that the said Sarpanch always enters into misbehaviour with the Panches, who are also the public elected members under Panchayati Raj Act and the inhabitants of their wards have high expectations from these Panches that their genuine issues/ grievances will be meted out on priority basis, but due to unwarranted acts of the said Sarpanch, the Panches are not able to dispense off their legitimate duties/ functions to the satisfaction of their ward residents.
They submitted that the Sarpanch in an unfair practice has kept all the belongings of Panchayat Office Nowpachi-B including Sports Items, V-SAT Equipments, under his custody at his residential house for personal use, which needs to be immediately recovered from him and placed at Panchayat Office Nowpachi-B for the use for which they have been sanctioned/ issued.
“As such, keeping in consideration of the set-out time frame for holding such meeting under U/SeC. 81(1) of P.R. Act, 1989 and Rues, 1996 thereof to be convened not earlier than 10 days and not later than twenty days. Accordingly, the present notice is submitted to set in motion the proceedings for No Confidence Motion U/Sec. 81(1) of P.R. Rules- against Sarpanch Bilal Ahmed Khanday of Pyt. Nowpachi-B Block Marwah, Distt. Kishtwar for onward necessary action in accordance with provisions contained under Panchayati Raj Act-1989, till then, all vested powers of Sarpanch and DSC thereof are liable to be seized to prevent any further financial loss to the Govt. Exchequer” read the letter of no confidence motion.
