Jammu: The Lieutenant Governor of Jammu and Kashmir, Manoj Sinha, has officially notified the Jammu and Kashmir Secretariat (Subordinate) Service Recruitment Rules, 2026. This marks the establishment of a comprehensive legal and administrative framework designed to govern the recruitment and service conditions of subordinate staff within the Civil Secretariat of the Union Territory.
Information was available with The Chenab Times that the new rules have been formulated under the proviso to Article 309 of the Constitution of India. They are set to take effect from the date of their publication in the official Government Gazette. The notification formally constitutes the “Jammu and Kashmir Secretariat (Subordinate) Service,” and it includes provisions for existing employees holding substantive posts within the sanctioned cadre, provided they meet the specified eligibility conditions. The rules explicitly state that only individuals appointed to regular posts under competent authority will be considered, excluding those on ad-hoc, deputation, or stop-gap arrangements.
The notification provides detailed definitions for key terms such as “Government,” “Union Territory,” “Cadre,” “Post,” “Administrative Department,” and “Board.” The Jammu and Kashmir Services Selection Board has been designated as the principal agency responsible for recruitment. For any terms not specifically defined within these rules, their meanings will be derived from the Jammu and Kashmir Civil Services Rules and Regulations, 1956.
Regarding the strength and composition of the cadre, the Government will determine the number and nature of posts as outlined in Schedule-I. The rules also allow for the creation of temporary posts as necessitated by administrative requirements. A mandatory review of the cadre strength and its composition is scheduled to occur every five years, or sooner if deemed essential.
Appointments to the service will be made through two primary channels: direct recruitment and promotion. All vacancies designated for direct recruitment will be referred to the Jammu and Kashmir Services Selection Board. Promotions, on the other hand, will be processed by the Departmental Promotion Committee, following the established existing rules.
Schedule-II of the notification details the eligibility criteria for both appointment and promotion. Candidates will be required to fulfill all specified qualifications and other recruitment conditions to be considered for these positions.
A mandatory probation period of two years is stipulated for individuals appointed through direct recruitment. During this period, their performance and confirmation will be managed in accordance with the Jammu and Kashmir Civil Services (Classification, Control and Appeal) Rules, 1956. Pay and overall service conditions for all appointees will be regulated under the Civil Services Regulations and other applicable rules.
Furthermore, the rules mandate the strict implementation of reservation in appointments, adhering precisely to the provisions of the Jammu and Kashmir Reservation Act and other relevant rules currently in force. All individuals, irrespective of whether they are appointed directly or through promotion, will be required to undergo prescribed training and successfully pass departmental examinations during their probation period. The specific details of this training and the examinations will be determined by the Government.
The rules also address the maintenance of seniority, stipulating that it will be strictly governed by the Civil Services Rules. For any matters not specifically covered by these new regulations, the general service regulations applicable to Union Territory employees will apply.
In instances of ambiguity or when interpretation issues arise concerning these rules, the matter will be referred to the General Administration Department. The decision rendered by this department will be considered final and binding on all parties involved.
A repeal and savings clause is also included within the notification. This clause states that all previous rules pertaining to the same subject matter stand repealed. However, any appointments or actions that were made or taken under the previous rules will be considered valid and will continue to be recognized under the new regulatory framework.
The introduction of these comprehensive recruitment rules is intended to streamline the process of filling subordinate positions within the Civil Secretariat, enhance transparency in recruitment procedures, and ultimately strengthen the overall administrative functioning of the department.
