Delhi Court Acquits Former AAP MLA Somnath Bharti in 2014 Assault Case

A Delhi court has acquitted Somnath Bharti, a former Aam Aadmi Party (AAP) MLA, in a 2014 case alleging assault on women of African nations. The acquittal came on Friday, bringing a conclusion to a case that had seen charges framed against the politician and others.

The Chenab Times has learned that Additional Chief Judicial Magistrate Neha Mittal delivered the verdict, acquitting Bharti of the charges documented in an FIR lodged at the Malviya Nagar police station. The court’s decision was based on the grounds that the statements provided by the prosecution witnesses were deemed inadmissible, as they did not depose before the court. The judge further stated that the prosecution had failed to adequately prove its case against the accused.

The specific details of the court’s reasoned order are still awaited. The prosecution’s case had alleged that Somnath Bharti and other individuals were involved in an assault on women from African countries during the intervening night of January 15 and January 16, 2014. At the time of the incident, Bharti held the position of Delhi’s law minister.

Bharti had previously contended that the women in question were reportedly engaged in illegal activities. Following the allegations, a court had framed charges against Bharti and others under various sections of the Indian Penal Code. These charges included those related to rioting, criminal trespass, outraging the modesty of a woman, and obstructing a public servant in the discharge of their duty.

The incident dates back to a period when Bharti was a prominent figure in Delhi’s political landscape. The alleged assault occurred following public concern and protests regarding alleged illegal activities in the South Delhi area. Bharti’s defence had maintained that his actions were aimed at curbing such activities.

The legal proceedings involved extensive arguments from both the prosecution and the defence. The prosecution presented its evidence and witness testimonies, aiming to establish Bharti’s involvement in the alleged assault. Conversely, the defence sought to discredit the evidence and highlight inconsistencies in the testimonies presented.

The court’s decision to acquit Bharti underscores the critical importance of witness testimony and adherence to procedural norms in legal proceedings. The inadmissibility of witness statements, as cited by the court, played a pivotal role in the outcome of the case. This highlights the stringent requirements for evidence to be admissible in court and for prosecution cases to be proven beyond reasonable doubt.

The case has drawn attention to the complexities of law enforcement and citizen action, particularly concerning allegations of illegal activities and their perceived handling. The acquittal of Somnath Bharti signifies that the court found the evidence insufficient to establish guilt according to legal standards.

While a reasoned order is anticipated to provide further clarity on the court’s detailed findings, the acquittal itself marks a significant development in the long-standing legal battle. The former MLA had faced considerable scrutiny and political fallout during the course of the trial.

The judgment is expected to be a subject of further discussion within legal and political circles, particularly concerning the prosecution’s ability to substantiate claims in such sensitive cases. The verdict also reiterates the principle that the burden of proof lies with the prosecution to present a compelling case that meets the legal threshold for conviction.
