The Tamil Nadu government has issued a directive mandating the presenceless registration of specific mortgage-related documents presented by banks and financial institutions. Effective September 15, this initiative encompasses the Memorandum of Deposit of Title Deeds (MODT) and Deed of Receipt, which are crucial for securing loans against property and confirming loan repayment, respectively. This move signifies the second phase of the state’s ‘Anywhere Registration’ scheme, operating under the Project STAR 3.0 digital registration platform.
Expansion of Digital Registration Framework
The decision to mandate presenceless registration for these documents was announced by the Minister for Commercial Taxes and Registration in the Tamil Nadu Assembly on September 7. The order, issued by the Commercial Taxes Department Secretary, operationalizes this announcement by extending the digital registration framework to these essential financial transactions. The presenceless registration system incorporates digital signatures from the registering authority and features QR-coded verification on each page of the registered document. This expansion leverages the existing digital infrastructure established by the Registration Department, rather than introducing entirely new systems.
Information was available with The Chenab Times that the MODT and Deed of Receipt documents were already enabled for presenceless filing since January 22, 2026. The current mandate aims to ensure a fuller utilization of this capacity. The primary objective behind this directive is to ensure that mortgage entries are accurately reflected in encumbrance certificates, which are vital for banks when assessing property liens before sanctioning loans. The enhanced digital process is expected to strengthen safeguards against the possibility of multiple mortgages being registered on the same property.
Streamlining Financial Transactions
The introduction of presenceless registration for these mortgage documents is designed to significantly streamline the processes for banks and financial institutions. It will enable them to submit required documents electronically, thereby eliminating the need to depute officials to physical Sub-Registrar Offices. This digital shift is anticipated to reduce physical footfall at registration offices, minimize manual intervention, and expedite the processing of transactions. Furthermore, the system is expected to improve the traceability of mortgage-related transactions and ensure the secure digital preservation of registered documents.
The first phase of the ‘Anywhere Registration’ initiative, launched on August 17, mandated presenceless filing for initial sales of plots by promoters, first sales of flats by builders, and connected deposit of title deeds for eligible bank-financed purchases. This latest order builds upon the progress made in the first phase by extending digital registration to the mortgage and receipt documents, further solidifying Tamil Nadu’s commitment to digitizing property transactions.
The implementation of the presenceless registration system for MODT and Deed of Receipt documents is part of a broader strategy to enhance transparency, efficiency, and citizen-friendliness in property dealings within Tamil Nadu.
