Shimla, Himachal Pradesh – Several individuals from Uttar Pradesh were reportedly paraded through Shimla by locals on Saturday following allegations that a man from Uttar Pradesh had harassed and blackmailed a 16-year-old girl. Local authorities have issued stern warnings against vigilantism and interference with ongoing investigations.
Information was available with The Chenab Times that the incident stemmed from a complaint filed by the girl’s father against a shopkeeper from Uttar Pradesh operating in Shimla. The complaint accused the shopkeeper of harassing his daughter and attempting to blackmail her with a video that depicted her speaking with another individual.
Responding to the complaint, the Himachal Pradesh Police registered a case. The legal action has been initiated under Section 8 of the Protection of Children from Sexual Offences (POCSO) Act and Section 75 of the Bharatiya Nyaya Sanhita (BNS), which replaced the Indian Penal Code. An investigation into the allegations is currently underway.
Confirming the sequence of events, Shimla Superintendent of Police Gaurav Singh stated that while the police were investigating the primary complaint, they also observed reports of certain individuals being subjected to public parading and assault. Mr. Singh clarified that the individuals who were paraded had not been named in the victim’s complaint, nor were they identified by her in connection with the alleged harassment.
The Superintendent of Police underscored that the police department will not tolerate any form of mob justice or unlawful activity. He issued a strong admonition, stating that strict legal action will be pursued against anyone found to be involved in intimidation, assault, taking the law into their own hands, or disrupting the judicial process. The directive aims to ensure that investigations are conducted fairly and without undue influence or violence.
The incident highlights a recurring challenge for law enforcement agencies in maintaining order and ensuring due process, particularly in situations where public sentiment is high. The parading of individuals, even when allegations are serious, can lead to unintended consequences, including the risk of assault on innocent parties or obstruction of justice. Authorities are emphasizing the importance of allowing the legal system to function without interference from the public.
The POCSO Act is a special law in India enacted to protect children from offences, including sexual abuse, and provides for stringent punishment for offenders. Section 75 of the BNS, which pertains to the protection of children, also aims to ensure the safety and well-being of minors. The integration of these legal frameworks signifies the seriousness with which such allegations are treated by the authorities.
The police are urging the public to report any suspicious activities or criminal behaviour directly to the police rather than resorting to vigilantism. The Shimla Police have assured the community that all complaints will be thoroughly investigated and appropriate action will be taken within the bounds of the law.
