SRINAGAR, Sept. 21 — The Jammu and Kashmir government has dismissed a government school teacher accused in a high-profile sexual assault case that triggered weeks of public outrage and protests across the Chenab Valley, invoking constitutional provisions that permit termination without a departmental inquiry in exceptional circumstances.
In an order issued on Monday, the School Education Department dismissed Khalid Hussain, a Grade-II teacher posted at Government Middle School Bumalpora, Gurinalla, in Kishtwar district’s Inderwal zone. The government said the dismissal takes immediate effect and permanently disqualifies him from future government employment in Jammu and Kashmir.
The action stems from FIR No. 34/2026 registered at Police Station Chatroo under multiple provisions of the Bharatiya Nyaya Sanhita (BNS), 2023, and the Protection of Children from Sexual Offences (POCSO) Act, 2012. The government said the material on record indicated conduct serious enough to warrant the imposition of a major penalty.
The case has drawn widespread attention since August, when allegations emerged that the teacher had sexually assaulted a 14-year-old student over several months. The minor died on Aug. 20 during an alleged forced abortion procedure, an incident that sparked widespread protests, shutdowns, and demands for justice across Kishtwar and other parts of the Chenab Valley.
Public anger intensified after news of the girl’s death spread across the region, prompting demonstrations and calls for swift action against all those allegedly involved in the case. The incident became one of the most widely discussed criminal cases in Jammu and Kashmir in recent months, with civil society groups, political leaders, and residents demanding accountability.
According to the government order, the case was placed before the competent authority, which concluded that dismissal from service was justified. Authorities cited Rule 30(viii) of the Jammu and Kashmir Civil Services (Classification, Control and Appeal) Rules, 1956, and said it was not reasonably practicable to conduct a departmental inquiry in the matter. The order further stated that Hussain’s continued employment would be detrimental to public interest and could undermine confidence in government institutions.
The government invoked sub-clause (b) of the proviso to Article 311(2) of the Constitution of India, a provision that allows dismissal without a departmental inquiry when authorities determine that holding such an inquiry is not reasonably practicable.
The order was issued under Government Order No. 388-JK(Edu) of 2026, dated Sept. 21, and signed by Ram Niwas Sharma, IAS, Commissioner/Secretary to the Government, School Education Department. Copies were forwarded to senior officials, including the Director School Education Jammu and the Deputy Commissioner of Kishtwar.
The dismissal marks one of the most significant administrative actions taken so far in the case, which has become a focal point of public concern in the Chenab region and has renewed calls for stronger safeguards for children in educational institutions.
