Jammu & Kashmir HC Quashes Contempt Notice Against Shopian Deputy Commissioner

SRINAGAR: The Jammu and Kashmir and Ladakh High Court has nullified a contempt notice that was issued against Shishir Gupta, the Deputy Commissioner of Shopian. The court determined that the judicial magistrate had exceeded the scope of his jurisdictional authority in seeking action against the Indian Administrative Service (IAS) officer.

Information was available with The Chenab Times that Justice Rahul Bharti, while adjudicating the case on August 7, observed that the Judicial Magistrate 1st Class in Shopian had employed a procedural approach not sanctioned by the Code of Criminal Procedure, 1973.

The proceedings originated from a maintenance case involving Idris Shah. The magistrate had previously ordered Shah to pay Rs 4.30 lakh in arrears to his estranged wife, Ufaira Gulzar, and their daughter. Following Shah’s failure to clear the outstanding dues, the magistrate requested details of his immovable property and subsequently issued a levy warrant to the Shopian Deputy Commissioner, invoking Section 421(1)(b) of the CrPC.

Further complicating matters, the magistrate issued another levy warrant against Shah on July 4. This sequence of actions prompted the High Court to scrutinize the recovery proceedings being conducted. Justice Bharti noted that the magistrate’s subsequent actions had the effect of frustrating the earlier levy warrant directed at the Deputy Commissioner, constituting an exercise of power beyond the legal framework.

Consequently, the High Court declared the show-cause notice issued on July 10 against Gupta as illegal and rescinded it. Simultaneously, the High Court instructed the magistrate to proceed with the recovery of the maintenance arrears using the legally established mechanisms.

The court mandated the issuance of a fresh levy warrant to the Collector, Shopian, for its execution under Section 91 of the Jammu and Kashmir Land Revenue Act, Samvat 1996. The Collector has been directed to facilitate the attachment and subsequent sale of Shah’s identified property. The proceeds from this sale are to be placed at the disposal of the magistrate for disbursement to the wife and daughter.

The High Court’s directive effectively absolved the Deputy Commissioner from the contempt proceedings while ensuring that the recovery process against Idris Shah could continue through the appropriate legal channels. The ruling clarifies the jurisdictional boundaries for magistrates in such recovery matters and reinforces adherence to established legal procedures.
